NAP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. NAP IS NOT CERTIFIED OR APPROVED FOR USE ON ANY PUBLIC ROADS. BY USING NAP, YOU ASSUME ALL RISKS ASSOCIATED WITH ITS USE.
§1Definitions and Construction
For purposes of this notice:
- "NAP" is the shorthand used throughout this notice to refer to the NotAutopilot codebase and distribution, including source code, compiled binaries, configuration files, packaging, installer artifacts, and accompanying documentation made available under the NotAutopilot name. "NAP" refers to the code artifact, not to any organization or person.
- "Project" means the organizational endeavor of NotAutopilot — the collective effort, mission, and governance of the NotAutopilot open-source initiative — including its maintainers, contributors, agents, representatives, and any other individuals or entities acting on behalf of, or in furtherance of, the NotAutopilot endeavor. The Project is the organizational counterpart to NAP; NAP is the artifact, the Project is the people and governance behind it.
- "User", "you", or "your" means any person who installs, downloads, executes, operates, modifies, distributes, or otherwise interacts with NAP.
- "Vehicle" means any motor vehicle on which NAP is installed or in which NAP is executed.
- "comma" means comma.ai, Inc., the developer and maintainer of the comma hardware platform and the openpilot driver-assistance software upon which NAP depends.
Where this notice uses general or catch-all terms following specific examples, those general terms shall be construed broadly and not limited by the specific examples preceding or following them. The doctrine of ejusdem generis shall not be applied to narrow the scope of any defined term in this notice.
§2Nature of NAP; Relationship to openpilot
NAP is alpha-quality, pre-release, experimental, and distributed for research, educational, and non-commercial evaluation purposes only. NAP is a community-maintained derivative work based on open-source components and is under active development. Functionality, behavior, interfaces, and safety characteristics may change, degrade, or be removed without notice.
NAP adapts openpilot — the open-source driver-assistance system developed and maintained by comma, which runs on comma's hardware platform (e.g., comma 3X, comma 4) — to the controller area network and electrical systems of pre-Autopilot Tesla Model S vehicles. The perception, planning, and driver-monitoring models that run while NAP is engaged are developed, trained, and maintained by comma as part of openpilot; the Project does not develop or train those models. Those models are machine-learned systems: their behavior is characterized through testing and observation rather than by inspection of source code, and it may vary in conditions that differ from those in which the models were trained or validated. The Project's work consists of the integration, configuration, and vehicle-specific control code required for openpilot to operate on pre-Autopilot Tesla Model S hardware.
§3No Certification or Approval
NAP has not been certified, approved, homologated, endorsed, inspected, or validated by the National Highway Traffic Safety Administration (NHTSA), the U.S. Department of Transportation, the European Union, the United Nations Economic Commission for Europe (UNECE), any state or provincial motor vehicle authority, any original equipment manufacturer, any insurer, or any other regulatory, governmental, or certifying body. NAP does not meet, and is not represented as meeting, any applicable safety standard, performance standard, or regulatory requirement.
§4Assumption of Risk
You acknowledge that the operation of a motor vehicle is an inherently dangerous activity, and that the installation and use of experimental driver-assistance software materially increases that risk. You expressly and voluntarily assume all risks, known and unknown, associated with NAP, including without limitation the risk of death, personal injury, property damage, loss of Vehicle control, mechanical failure, electrical failure, software malfunction, unexpected behavior, sudden disengagement, delayed response, and any other consequence arising from or related to NAP or its use.
§5User Responsibility
NAP is not a self-driving system. NAP does not replace, diminish, or modify your obligations when operating the Vehicle. At all times while NAP is installed, active, or running, you (the User) shall:
- Keep both hands on the steering wheel.
- Keep your eyes on the road.
- Remain alert, sober, unimpaired, and fully attentive to the operation of the Vehicle.
- Be prepared to take immediate manual control of the Vehicle at any time and without warning.
- Comply with all applicable laws, regulations, and ordinances in the jurisdiction in which the Vehicle is operated.
- Maintain the Vehicle in a mechanically sound, roadworthy condition.
NAP may behave unexpectedly, fail silently, disengage without warning, or produce incorrect outputs at any time. You are the sole and final safety authority for the Vehicle.
§6Intended Use; Prohibited Uses
NAP is intended for evaluation on closed courses, private property, and other controlled non-public testing environments. Operation on public roads is not recommended and may be unlawful in your jurisdiction. You shall not use NAP:
- In any commercial service, including without limitation ride-sharing, delivery, livery, taxi, or fleet operations.
- In violation of any applicable law, regulation, or ordinance.
- To transport passengers who have not been made aware of, and have not accepted, the experimental nature of NAP.
- In any manner that endangers other road users, pedestrians, or property.
§7Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROJECT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE PROJECT OR ANY CONTRIBUTOR SHALL CREATE A WARRANTY. THE PROJECT DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
§8Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROJECT, ITS MAINTAINERS, CONTRIBUTORS, OR ANY AFFILIATED INDIVIDUALS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, VEHICLE, PROPERTY, BODILY INJURY, OR DEATH, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS NOTICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE PROJECT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
§9Indemnification
You agree to defend, indemnify, and hold harmless the Project, its maintainers, contributors, and affiliated individuals from and against any and all claims, actions, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use or misuse of NAP, (b) your violation of this notice, (c) your violation of any law or the rights of any third party, or (d) any operation of a Vehicle on which NAP is or has been installed.
The foregoing indemnification obligation shall not apply to the extent that any claim, loss, liability, damage, cost, or expense is caused by the gross negligence, wantonness, recklessness, or willful misconduct of the Project, its maintainers, or contributors. Nothing in this section shall be construed to require indemnification for conduct that may not lawfully be indemnified against under applicable law.
§10No Affiliation; Trademarks
NotAutopilot is an independent, community-operated open-source project. It is not affiliated with, endorsed by, sponsored by, reviewed by, approved by, or connected in any way with the following parties, and no such relationship should be inferred:
- Tesla, Inc. "Tesla", "Model S", "Autopilot", and related marks are trademarks or registered trademarks of Tesla, Inc.
- comma.ai, Inc. "comma", "comma.ai", "comma 3X", "comma 4", and related marks are trademarks of comma.ai, Inc. References to comma hardware describe compatibility only and do not imply endorsement.
- The openpilot project. "openpilot" is a trademark or trade name associated with comma.ai, Inc. NotAutopilot is an unofficial, third-party derivative work. Use of the name "openpilot" on this site is descriptive and nominative only.
All trademarks, service marks, trade names, and logos referenced on this site are the property of their respective owners. Use of such marks is for identification and descriptive purposes only and does not constitute or imply endorsement, sponsorship, or affiliation.
§11Not Legal or Technical Advice
Nothing on this site or in NAP constitutes legal, regulatory, insurance, mechanical, or engineering advice. You are responsible for obtaining qualified professional advice before installing, modifying, or operating any driver assistance system on a motor vehicle.
§12Severability
If any provision of this notice is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
§13Governing Law; Jurisdiction; Venue
This notice, and any claim, dispute, or matter arising out of or relating to NAP or this notice, shall be governed by and construed in accordance with the laws of the State of Alabama, United States of America, without regard to its conflict-of-laws principles.
Any action or proceeding arising out of or relating to NAP or this notice shall be brought exclusively in the Circuit Court of Jefferson County, Alabama, or, where federal jurisdiction exists, in the United States District Court for the Northern District of Alabama, Southern Division. You consent to the personal jurisdiction of, and venue in, such courts, and waive any objection to such jurisdiction or venue, including any objection based on forum non conveniens.
The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this notice or to NAP.
§14Entire Agreement; Modification
This notice constitutes the entire understanding between you and the Project with respect to NAP's safety posture and liability framework and supersedes any prior communications. The Project may update this notice by posting a revised version at this URL and updating the "Last updated" date above. Material changes will also be reflected in the terms presented for acceptance on the device.
§15Acknowledgment
BY INSTALLING, DOWNLOADING, EXECUTING, OPERATING, OR OTHERWISE USING NAP, YOU REPRESENT AND WARRANT THAT YOU HAVE READ THIS NOTICE CAREFULLY, THOROUGHLY, AND IN FULL, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS. IF YOU DO NOT AGREE, YOU MUST NOT INSTALL OR USE NAP.
